These Terms of Service (“Terms”) govern your access to and use of qiyuanai.club, including purchases made through the website. The website and store are operated by David FINN under the name RAW RADICAL (“RAW RADICAL,” “we,” “us,” or “our”).
By using the website or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the website. These Terms do not waive any right or remedy that cannot lawfully be waived under the law of your state.
1. Eligibility and Authority
You must be at least the age of majority in your state of residence and legally able to enter into a contract to place an order. A parent or legal guardian may use the website on behalf of a minor and is responsible for that use. If you use the website for a business or other organization, you represent that you have authority to bind it.
2. Products, Descriptions, and Availability
We try to describe and display products accurately, including materials, dimensions, colors, and features. Screen settings, lighting, photography, and production variations may cause reasonable differences in appearance. A material difference, defect, or item that does not conform to an express description remains subject to your rights under our Refund and Returns Policy and applicable law.
Products and quantities may be limited and may be changed or discontinued. We may correct genuine typographical, technical, availability, or pricing errors. If an error materially affects an order you already placed, we will notify you and offer the choice required by law, including cancellation and a full refund when appropriate. We will not substitute a materially different product without your consent.
3. Prices, Taxes, and Promotions
Prices are displayed in U.S. dollars unless stated otherwise. Applicable sales tax, shipping charges, and other charges are shown before you submit your order. Prices may change prospectively without notice, but we will not increase the price of an accepted order without your express agreement except to correct an obvious error as permitted by law.
Promotions, discount codes, and gift offers are subject to the terms disclosed with the offer. Unless expressly stated otherwise, they cannot be combined, exchanged for cash, or applied retroactively. We may cancel a promotion obtained through fraud, abuse, or a clear technical error, subject to applicable law.
4. Orders and Contract Formation
Your order is an offer to purchase. An automated acknowledgment confirms receipt but does not necessarily mean we have accepted the order. We accept an order when we send a shipping confirmation or otherwise expressly confirm acceptance. We may refuse or cancel an order for legitimate reasons such as unavailability, a material pricing error, suspected fraud, payment failure, legal restrictions, or limits intended to prevent resale abuse. If we cancel after payment, we will issue a prompt refund to the original payment method.
You are responsible for providing accurate billing, shipping, and contact information. Purchase limits may apply when clearly disclosed or reasonably necessary to address fraud or inventory constraints.
5. Payment
You authorize us and our payment processors to charge the payment method you select for the total disclosed at checkout. Payment processing is also subject to the processor’s terms and privacy practices. We do not offer recurring subscriptions or automatic renewals unless the recurring nature, frequency, price, cancellation method, and any trial terms are clearly disclosed and separately authorized before purchase.
6. Shipping, Delivery, Returns, and Refunds
Shipping and delivery are governed by our Shipping Policy. Returns, exchanges, cancellations, and refunds are governed by our Refund and Returns Policy. Those policies are incorporated into these Terms. If a policy conflicts with a mandatory consumer law, the mandatory law controls.
7. Accounts and Account Security
If you create an account, you must provide accurate information and keep your login credentials confidential. Notify us promptly if you suspect unauthorized access. You are responsible for activity you authorize, but nothing in these Terms makes you responsible for unauthorized activity to the extent applicable law provides otherwise. We may suspend an account when reasonably necessary to protect customers, the website, or legal rights.
8. Acceptable Use
You may not use the website to violate law or another person’s rights; commit fraud; submit false payment or identity information; distribute malware; scrape, crawl, or overload the website in a manner that interferes with normal operation; bypass access or security controls; reverse engineer protected website functions except where law permits; impersonate another person; or use content in a misleading or infringing manner.
We may restrict access for a material violation, but will not use this provision to deny a valid order, refund, warranty, or statutory consumer claim.
9. Reviews, Feedback, and Other User Content
If you submit a review, photograph, comment, or other content, you retain ownership of your content and grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute it for operating and promoting RAW RADICAL. This license lasts only as reasonably necessary for those purposes, subject to rights you may have under applicable law.
You represent that you have the necessary rights to submit the content and that it is truthful, relevant, and not unlawful, defamatory, deceptive, private, or infringing. If you received compensation, a discount, a free product, or another material connection for an endorsement, you must clearly disclose it. We may moderate content for legitimate reasons, but we do not require positive reviews and will not suppress a truthful negative review merely because it is negative.
10. Intellectual Property
The website’s design, text, graphics, logos, photographs, software, and other content are owned by or licensed to RAW RADICAL and are protected by intellectual-property laws. We grant you a limited, revocable, nontransferable right to use the website for personal, lawful shopping and information purposes. No ownership right is transferred to you. Rights in third-party names and content remain with their owners.

The website may use or link to third-party services, such as payment processors, carriers, analytics providers, social networks, or external websites. We are not responsible for third-party content or conduct outside our reasonable control, but this does not limit our responsibility for our own obligations, our selection or use of service providers where law imposes responsibility, or products we sell.

13. Warranties and Consumer Guarantees

We do not promise that the website will always be uninterrupted or error-free. 14. Limitation of Liability
To the maximum extent permitted by applicable law, neither RAW RADICAL nor its service providers will be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website when such damages were not reasonably foreseeable. This limitation does not apply to amounts paid for an affected order, valid refund or warranty obligations, personal injury, death, property damage caused by a defective product, fraud, gross negligence, willful misconduct, violation of privacy or data-security duties, infringement, or any liability that cannot legally be excluded or limited.
Some states do not allow certain exclusions or limitations, so all or part of this section may not apply to you. In those states, liability is limited only to the extent the law permits.
15. Indemnification
To the extent permitted by law, you agree to reimburse RAW RADICAL for reasonable losses and expenses arising directly from your unlawful use of the website, your knowing infringement of another person’s rights, or content you submit in violation of these Terms. This obligation does not apply to losses caused by us, to ordinary consumer use, or where prohibited by law. We will provide reasonable notice of a covered claim and allow reasonable participation in the defense.
16. Informal Dispute Resolution; No Mandatory Arbitration
Before filing a lawsuit, you and RAW RADICAL are encouraged—but not required—to try to resolve the dispute by emailing support@qiyuanai.club with the order number, a description of the issue, and the requested resolution. This informal process does not extend a legal deadline unless the parties agree in writing.
These Terms do not require binding arbitration and do not waive any right to participate in a class or representative action that applicable law allows. Either party may use an eligible small-claims court.
17. Governing Law and Venue
These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles. However, this choice does not deprive a consumer of any mandatory protection, remedy, or venue right provided by the law of the state where the consumer resides. Subject to those mandatory rights, disputes may be brought in a court of competent jurisdiction in San Diego County, California. Nothing here prevents either party from bringing an eligible claim in small-claims court or seeking relief from a government agency.
18. State-Specific and Non-Waivable Rights
Residents of California and every other U.S. state retain all non-waivable rights and remedies under their state’s consumer-protection, unfair or deceptive practices, warranty, commercial, privacy, automatic-renewal, accessibility, and other applicable laws. If any provision of these Terms conflicts with a mandatory law, it is modified only to the minimum extent necessary, and the remaining provisions remain effective.

19. Suspension, Termination, and Website Changes
You may stop using the website at any time. We may suspend or terminate access for a material violation, fraud, security threat, or legal requirement. Termination does not cancel an accepted order, refund, warranty, privacy request, or other accrued obligation unless lawful and expressly communicated. We may change or discontinue website features prospectively, subject to obligations for existing orders.
20. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date identifies the current version. Material changes apply prospectively unless applicable law requires otherwise. When required, we will provide additional notice or obtain consent. The Terms in effect when you place an order generally govern that order.
21. General Provisions
If a provision is invalid or unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign an account or these Terms in a way that transfers obligations without our consent, but this does not restrict rights that law makes transferable. We may assign these Terms as part of a legitimate business transfer only if customer rights are not materially reduced. These Terms and the policies they incorporate constitute the agreement regarding the website and store, except for any additional product-specific terms disclosed before purchase.
